Annual Leave in a time of pandemic: what are the laws in Australia?

1 July 2021 – In Australia, annual leave accumulates from the day you begin work, regardless of whether you are on probation. It also accumulates when a person is on jury duty, engaging in community service, and/or on another type of paid leave.

While on leave, employees must be paid the base rate of pay, including additional payments like allowances, overtime, and penalties. Leave loading, a common occurrence in organisations, can result in the employer paying higher than the base pay rate. In such a case, the employer is required to provide a breakdown of leave loading on the employee's pay check/pay slip in addition to showing how much of leave has been accumulated. This is required by Australian Law.

Paid leaves are beneficial to both company and employees. For the employee, it makes time for when they are sick, mentally exhausted/overworked, spending time with family etc. On the other hand, companies benefit from better productivity and employee retention.
