What is Age Discrimination? 

Discriminating against an employee based on their age is illegal in Zambia. Even though there is no piece of legislation that specifically talks about age discrimination, the employment act says no person shall be discriminated against based on their race, sex, religion and in this case on their "age".

When does Age Discrimination occur? 

It occurs when an employer opts to employ a person based on their age rather than on qualification or experience. A person may be employed because they are young and energetic but without any qualification, while a highly qualified person maybe denied employment because they are old.

What does the law say?

The law prohibits any form of discrimination. Any person who has been declared fit for duties by a qualified medical practitioner and is below retirement age shall be allowed to carry out their duties until such a time that they are declared incapable by qualified assessors.

What can you do when you are discriminated against based on your age?

Whether you are a fresh graduate or an elderly person and you feel that you have been discriminated against based on your age, report your case to the Officer of the Labour Commissioner or any Labour Officer in your area.
