What is commuting time?

Commuting time is the time spent going to work from home and vice versa.

Do Tanzania labour laws cover commuting time?

Labour laws in Tanzania make no provision for payment of commuting time. An employee is paid for hours ordinarily worked.

Does the commuting time form part of working hours?

The commuting period is not part of working hours and is thus not paid.

Are there any exceptions for paid commuting hours?

The law does not provide for payment for commuting hours and neither does it provide for a transit allowance. However, before May 2010 the law used to provide transit allowances to employees of some sectors when they travelled to another city/region. The sectors which entitled its employees to a transit allowance included Agricultural Services, Commerce,  Industry and Trading, Marine and Fishing Services and Private Security Services.

When the new law i.e The Wage Order, 2010 came into effect it abolished this entitlement. However, an employer is not barred from paying this. Employers and trade unions can decide to have it included in their Collective Bargaining Agreements or even HR Policy or employment contracts.

What if the commuting time take me more than a working day?

Since there is no provision for payment for commuting hours it does not become mandatory to pay. However, employers and employees may negotiate and agree to have such a provision in the employment contract or other internal policies of the company.
