Sexual Harassment

The Labour Code prohibits sexual harassment of the employee by the employer. However, the law is silent on sexual harassment in other situations.

Sexual harassment is regarded as unfair labor practice in the Labour Code, and in such a case, the appropriate punishment is determined by the Labor Court.

Any person who offers employment or who threatens dismissal or who threatens the imposition of any other penalty against another person in the course of employment as a means of obtaining sexual favours or who harasses workers sexually commits an unfair labour practice.
