Who pays when I am sick, according to the law?

The law does not make an explicit provision for this; however in practice various conditions of service and collective agreements have provisions for payment when a worker is sick or on sick leave.

What happens if I am ill for a long time?

The law has no provision for this, but in practice various conditions of service and collective agreements provide full payment up to a period of time and in some instances half payments depending on the length of service of the worker.

What happens if the illness is related to the job?

If the illness is job-related, the Workmen’s Compensation Law, 187, 1987 makes express provision for full payment of wages, medical treatment and appropriate compensation to the worker.

What happens if after the sick leave period  a worker is unable to return to work?

Under such circumstance, a medical board is instituted to examine the sick worker. If the situation is such that he/she cannot return back to work, the employee is boarded off and retired on medical grounds.

Can an employer terminate a sick worker?

The Labour Act, 2003, grants that an employer may terminate the employment of a worker because of the inability of the worker to carry out his/her work due to sickness

Are sick employees compelled to offset their annual leave with sick leave?

No. The Labour Act, 2003 requires that “periods of absence from work allowed owing to sickness which is certified by a Medical Practitioner shall not be computed as part of leave”.

What happens if the illness is related to gender?

The law has no such provision.  Practically sick/medical provisions in collective agreements do not have special gender provisions

What does the law say about HIV/AIDS and work?

Currently the Labour Laws do not have any special provisions on HIV/AIDS. However the National HIV/AIDS Policy makes some specific interventions for workers who are either affected or infected. This includes VCT, medical care, non-disclosure of status, elimination of discrimination and stigma etc.

What does the law say about medical insurance?

There is no such provision in the law; however some collective agreements and conditions of service provides for an insurance policy cover for workers most especially for accidents, occupational injuries and diseases, and life insurance, among others.

What does the law say about OBS/GYN and other related services?

The law is silent on this.  Provisions in workers’ conditions of service generally do not cover payments for OBS/GYN appointments and related treatments.
